The Coalition for Truth and Justice in an open letter dated November 30, signed by its National Coordinator, Chief Charles Timothy, and addressed to President of the Senate, Dr. Abubakar Bukola Saraki, and copied President Muhammadu Buhari, Minister of Defence, Chief of Defence Staff and the Secretary to the Government of the Federation, said it found the resolution strange, unwholesome and abuse of the extant procedures of the Armed Forces of Nigeria Act 2004 and a subtle attempt to usurp the functions of the Armed Forces Council and the Nigerian Army Council.

A Federal High Court in Uyo, presided over by Justice F.O. Rima, on February 27, 2017, delivered a well considered judgement in a pre-election matter that lasted for about two years in courts and annulled the Certificate of Return of Senator Bassey Akpan and ordered the Independent National Electoral Commission to issued a fresh Certificate of Return to Hon Bassey Etim.

Among the grounds are that the Plaintiff wrongly joined several causes of action in his Originating Summons; that an action for the enforcement of fundamental rights to fair hearing can only be brought against a court or a tribunal, established by law as held by the Supreme Court in several current cases, and not against Committee of a legislative body; and that by the provisions of sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, the trial court lacked requisite jurisdiction to hear the suit of the Plaintiff.
