An Abuja High Court on Tuesday ordered the Inspector General of Police and the FCT Commissioner of Police to grant bail to three men who have been in detention for 11 months.
The three – Solomon Adole, Sunday Jerome and Christopher Vincent – are Makurdi, Benue State-based businessmen.
Justice Jude Okeke gave the order after hearing an application filed by Adole, Jerome and Vincent through their counsel, Diskson Omaiye, urging the enforcement of their fundamental human rights.
Okeke also held that the detention of the three without being charged by the police was unconstitutional.
He adjourned the matter to September 2 to deliver judgment in the suit for the enforcement of their fundamental human rights.
Earlier, Omaiye told the court that he had served the court processes on the two respondents but they were not in court and had yet to reply to any court process.
Omaiye is praying the court for an order that the continuous detention of the applicants without a formal charge for 11 months violates Section 35 and 41 of the Constitution of the Federal Republic of Nigeria.
He also wants the court to declare that the arrest and detention of the applicants by the respondents without trial for 11 months is unconstitutional.
They are also seeking N100 million as compensation for “unlawful arrest and detention”.
