The appeal is in relation to the ongoing Saraki’s trial at the Code of Conduct Tribunal for allegedly failing to declare his assets with the Code of Conduct Bureau.
Saraki, in a series of tweets on his Twitter handle on Monday night, said he will appear before the CCT on Tuesday morning (today) and ask that his trial on a three count charge as ordered by the Court of Appeal proceeds immediately
The court was billed to hear an application for an order compelling the Chief of Army Staff, Lieutenant General Tukur Burutai; and the Judge Advocate of the Nigerian Army Court Martial, Colonel S.I. Musa, to produce the records of the proceedings of the Special Court Martial that recommended the applicant for sack before the court and an application seeking to stay the execution of the decision of the army panel.
Delivering the judgment, Justice Abubakar Yahaya, said the court’s decision was as a result of the applicant’s withdrawal of his pending motions fixed for hearing.
