A 30-year-old man, Usman Animashaun, has been remanded at the Ikoyi Prisons for allegedly belonging to a secret cult and stabbing a person to death in a revenge cult attack.
The Ebute Meta Chief Magistrates’ Court in Lagos State, presided by Chief Magistrate Nurudeen Layeni, on Monday ordered the remand of the accused in prison.
Layeni said the plea of the accused would not be taken because the charges against him were capital offences requiring the advice of the Director of Public Prosecutions for the court to proceed.
He ruled: “I, therefore, order that the accused be remanded at the Ikoyi Prisons, pending the DPP’s advice.”
Earlier, the prosecutor, Inspector Mathew Akhaluode, said the accused, a resident of 1, Alhaji Animashaun Street, Agbelekale area of the court’s jurisdiction, committed the offences on November 8, 2015.
Akhaluode said the four-count charge of unlawful killing, conspiracy and belonging to a secret court leveled against the accused was committed at 10.30pm at Vulcanizer Bus Stop, near his abode.
He said Animashaun did stab one 32-year-old Samuel Onatayo to death, while carrying out the instructions of the Eiye Fraternity Cult that he was a member of.
He said: “The accused is a member of the Eiye Fraternity Cult and he stabbed Onatayo on his back and neck with a kitchen knife during one of their retaliation operations.
“Onatayo died as a result of the stabbing.”
The offences, according to the prosecutor, contravene Sections 41, 42(a), 221 and 231 of the Criminal Law of Lagos State, 2011.
The News Agency of Nigeria reports that Section 221 prescribes life imprisonment for offenders, while any person that contravenes Section 42 will be sentenced to three years in prison.
The case was adjourned till February 25 pending receipt of the advice of the DPP.
