The PDP, through its counsel, O.J. Onoja, SAN, told Justice Inyang Ekwo of a Federal High Court, Abuja in a motion for joinder marked: FHC/ABJ/CS/650/2021 dated and filed September 30.

Onifade, in an originating summons marked: FHC/ABJ/709/2021 dated and filed July 19 before Justice Inyang Ekwo, sued five respondents in the matter.

At the resumed hearing of the matter on Tuesday, Odili’s Counsel, Ifedayo Adedipe (SAN), told the court that the NIS served him a preliminary objection challenging the jurisdiction of the court to hear the matter.

Justice Inyang Ekwo gave the order while delivering judgment in an application filed by the former governor seeking an order of court prohibiting the EFCC from retrying him on a charge for which he had already been tried and convicted.

When the matter was called, Odili’s counsel, Ifedayo Adedipe, told the court that the matter was a fundamental rights enforcement suit and that he was ready to proceed with the motion.

Justice Inyang Ekwo adjourned the matter following inability of the parties in the suit to regularise their amended processes to accommodate the 5th defendant (Attorney-General (AG) of Adamawa), who had been joined in the case.

The Attorney-General of Adamawa, Afraimu Jingi, told Justice Inyang Ekwo while moving a motion on notice, seeking to be joined in the suit filed by a group against Atiku and three others.

Slok, which is owned by former Governor of Abia, Orji Uzor Kalu, is seeking the court order restraining the EFCC from trying it and Kalu

Justice Inyang Ekwo granted Osipitan’s plea after her counsel, Tayo Oyetibo, SAN, moved the motion on notice, which was not opposed to by the Economic and Financial Crimes Commission’s lawyer, Christopher Mshelia. 

Justice Inyang Ekwo gave the warning after Dr. Hassan Liman, counsel to the Economic and Financial Crimes Commission (EFCC) in the alleged N5 billion trial against Oduah and eight others, told the court that the former minister and one other defendant were not in court to take their plea.

Justice Inyang Ekwo fixed the date after listening to the ex-parte motion of the plaintiffs’ counsel, Kanu Agabi, SAN, praying the court for an order to serve the 1st and 2nd defendants by substituted means through pasting the originating process at Zamfara State Liaison Office in Abuja.

Justice Inyang Ekwo gave the warning on Monday when Oduah (a Senator, representing Anambra North) and some other defendants were absent at the proceedings, with no explanation from their lawyers.

Justice Inyang Ekwo fixed the date after parties in the matter adopted their processes in relation to the suit.

The amount is the 13 per cent derivative sum due as arrears of revenue and payable to the Bayelsa government.

Justice Inyang Ekwo, who gave the order while delivering a judgment in the suit brought by the CJ against Governor Oluwarotimi Akeredolu, and others, described the move to probe the embattled judge as “unconstitutional and illegal.”
 

The senator, who is popularly referred to as Dancing Senator, bagged the degree on May 7.

Ibezim took the oath of office at exactly 11:02am during the start of plenary. 

The group; the Incorporated Trustees of Alaigbo Development Foundation, urged Justice Inyang Ekwo to restrain the defendants from continuing the exercise pending the hearing and determination of the suit.

Counsel to the Attorney General of the Federation (AGF), Magaji Labaran, tendered the bags of money before Justice Inyang Ekwo while leading the only witness in the case, Stephen Olatubosun, in evidence.

Justice Inyang Ekwo gave the order, on Wednesday, after the currencies, stashed in three bags, were counted with a counting machine at the office of the Deputy Chief Registrar (Litigation) of the court as directed by the judge.
