A former Governor of Plateau State, Joshua Dariye, on Tuesday abandoned his “no-case submission” in an FCT High Court in Gudu.
Dariye, however, filed in the number of witnesses that would testify for the defence.
Dariye’s Counsel, Garba Pwul (SAN), told the court: “We have filed in a set of witness summons to enable us to start trial and a motion to conduct a defence.”
Pwul, who filed a temporary objection along with the witness summons, also said one of the witnesses was in Akwa Ibom State.
He told the court that three witnesses would be taken at the next hearing.
On June 6 when the EFCC closed its case against Dariye, Pwul had said that he had three witnesses.
Pwul had also told the court on June 10 that because he could not get the record of proceedings of four of the prosecution witnesses, he intended to file a no-case submission.
Dariye is standing trial on a 23-count charge bordering on money laundering and diversion of state funds.
Justice Adebukola Banjoko adjourned continuation of hearing till June 17.
