The Peoples Democratic Party in Ekiti State has said it would use all legal and constitutional means to ensure that the state Chairman of All Progressive Congress, Chief Jide Awe, is re-arrested and prosecuted for the murder of Ayo Jeje and Madam Adewumi.
A Federal High Court sitting in Jos, the Plateau State capital, had on Mondayrestrained the police from re-arresting Awe and four others for alleged murder of Jeje and Adewumi, who were killed during a political crisis in Erinjiyan-Ekiti on March 31, 2013.
Others to enjoy the relief are Faboro Ojo John, Aniramu Basiru, Falayi Busuyi and Owonifari Sefiu.
The Governor Ayo Fayose-led government, through the Ministry of Justice, had directed the Commissioner of Police, Taiwo Lakanu, to re-arrest and prosecute Awe and others for the crime.
The APC members had since been declared wanted by the police.
This was after the state government had revoked the noelle prosecui earlier entered in the cases by the former administration of Dr. Kayode Fayemi.
Ruling on the exparte motion, Justice A. Lewis-Allagoa granted all the reliefs sought by the applicants pending the determination of the originating motion on notice.
The court adjourned the matter to December 3, 2014 for hearing.
But in a statement on Wednesday by the Publicity Secretary of PDP, Joseph Adaraniwon, the PDP described the injunction as “kangaroo”, which cannot stand or prevent the law enforcement agents from performing their lawful duty, particularly on a serious murder charge.
The PDP was reacting to a statement credited to the state Publicity Secretary of the APC, Taiwo Olatubosun, on the injunction granted by the Federal High Court in Jos.
The PDP added: “It should be noted that no cash and carry judges should hold this country to ransom.
“The long arm of the law will catch up with Chief Jide Awe and others anywhere they are sighted.”
