Despite a judgement by a High Court of Justice in Lapai, Niger state that ruled a land dispute in favour of a plaintiff, Alhaji Etsu Ahmadu Isah, a Divisional Police Officer in Agaie Division, Assistant Superintendent of Police (ASP) Francis Emeo has overruled the High court’s judgement by arresting the plaintiff for going to Court of law.
Solicitors and Principal Counsel to the plaintiff Jonathan Gunu Taidi said in a petition made available to The Eagle Online that the DPO is allowing himself to be used by the Agaie emirate council just to satisfy the man who did not win in court.
According to Taidi “this appears to be that he (Emeo) has overruled the judgement of the High Court because once you do not give effect to the judgement of a High Court then you are impeding the judgement. He is trying to please the Agaie emirate council because of interests.
“They had filed an appeal after they felt dissatisfied; instead of them to pursue their appeal they came back to Agaie and liaise with the DPO to arrest my client.
“The DPO arrested my client on Friday and he is still in detention. His reason for the arrest was that, my client went to court with the case, knowing well that he has the constitutional rights to go to court.”
In the petition, Taidi said that the High Court of Justice in Niger state sitting at Lapai had delivered judgement over land situated at Gbawugi in favour of our client Etsu Ahmadu Isah and as Solicitor, he had written a letter concerning the DPO dated 18th August, 2014.
He said “our letter wherein we brought to your attention the action taken by the DPO, Agaie Division against person he is under law expected to protect.
“When our client whose subjects are victims reported to the Agaie Division, they were told by the DPO that he was in Niger state to ‘make money’.”
Taidi however condemned the romance between the Agaie Emirate council and the defendants Alhaji Ndalikali Ibrahim and Alhaji Audu of Wanigi via Agaie after a judgement by the High Court on January 22nd 2014 declared that all land purportedly sold or administered by them remain illegal, null and void.
He charged the relevant authorities for an urgent intervention by investigating ASP Francis Emeo and taking appropriate action against him in order to restore confidence in the law abiding citizens of Gbawugi.
