The Federal High Court sitting in Abuja on Friday refused a motion ex parte brought by one Elder Sunday Soledolu seeking to stop the Ogun State Peoples Democratic Party from holding the state House of Assembly primaries scheduled for Saturday.
Joined as plaintiffs are the state Chairman of PDP, Chief Adebayo Dayo; the PDP; and the Independent National Electoral Commission.
The plaintiff through his counsel, Oviemumo Obobolo of Festus Keyamo chambers, had through a motion ex parte prayed for an interlocutory injunction restraining the PDP and Dayo from holding primaries for various elective positions pending the determination of the suit.
In a short ruling, the trial judge, Justice A. R. Mohammed, refused the application and ordered the plaintiff to put the defendants on notice.
Mohammed consequently adjourned till December 4 for hearing.
In a 17-paragraph affidavit of urgency deposed to the plaintiff himself, Soledolu averred that he assumed office sometime in 2012 as the deputy chairman of the party alongside Dayo and other members for a period of four years, but was suspended on November 6, 2013 on the allegation that I want to assassinate the chairman.
He further averred that the chairman proceeded to make illegal appointment of Leye Odunjo as the acting deputy chairman for Ogun State the following day and had since appointed two other persons as deputy chairman of the PDP in Ogun State.
The plaintiff also averred that he has been deprived from exercising the powers of his office as the deputy chairman.
He added that he was also bye-passed from participating in the just concluded South West zone congress held in November 2014.
Soledolu however prayed for an interlocutory injunction restraining the defendants from refusing to accord recognition and every facility required by law to him for the purpose of the exercise of his duties as the deputy chairman.
