The Court of Appeal has set aside the ruling of Justice Okon Abang of the Federal High Court which ordered the Independent National Electoral Commission, INEC, to recognise Jimoh Ibrahim of Ali Modu Sheriff faction of the PDP as the governorship candidate of the party in the November 26 governorship election in Ondo state.
Consequently, Justice Salauwa, who delivered the judgment on Wednesday afternoon, directed INEC to publish the name of Eyitayo Jegede of the Ahmed Makarfi faction as the governorship candidate of the PDP.
Justice Abang had earlier ordered INEC to substitute the name of Eyitayo Jegede with that of Jimoh Ibrahim, consequent upon which the former headed to the Court of Appeal.
But, while the Appellate Court was hearing the matter, Ali Modu Sheriff faction filed motions for stay of proceedings at the Supreme Court.
Ruling on Tuesday, the Acting Chief Justice of Nigeria, Justice Walter Onoghene, who presided over the matter ordered the Court of Appeal to rule on the appeal brought before it by Eyitayo Jegede.
