The News Agency of Nigeria reports that other defendants in the charge marked FHC/ABJ/57/2022, are four members of the disbanded Police Intelligence Response Team (IRT).
Justice Emeka Nwite gave the order following an application to the effect by Sunday Joseph, counsel for the National Drug Law Enforcement Agency (NDLEA).

Kyari, in a notice of preliminary objection marked: FHC/ABJ/CS/249/2022 dated and filed on May 19 by Chief Kanu Agabi, SAN, before Justice Inyang Ekwo, said the AGF’s reply was filed out of time and without leave of court first sought and obtained.
Justice Inyang Ekwo dismissed the suit after counsel for the NDLEA, Joseph Sunday, prayed the court that the matter be struck out.
The development occurred when Nureni Jimoh, SAN, who was counsel for Kyari, told Justice Inyang Ekwo shortly after the matter was called for mention that he was yet to be served with the AGF’s processes.
She reportedly slumped on the ground shortly after trial Justice Emeka Nwite deferred ruling on applications that DCP Kyari and six other persons facing drug trafficking charges with him, filed to be released on bail pending the determination of the case against them.
Justice Emeka Nwite fixed the date after counsel for the prosecution and defence argued their applications for and against the bail plea.
Recall that the High Court on the 4th of November, 2021 granted the Applicant, Patrick Eholor leave to file the action against the Attorney General of the Federation and Inspector General of Police. Recall further that the matter was further adjourned to 22nd of November, 2021 for hearing. However, the plaintiff failed to file the substantive suit nor serve the Order of Court on the Respondent.

They were brought into the court room around 8am in two batches of four and two, by armed operatives of the National Drug Law Enforcement Agency (NDLEA).
