The Acting National Chairman of the Peoples Democratic Party, Chief Uche Secondus, has filed an appeal at the Court of Appeal over a court order that he should vacate office within 14 days.
This is coming less than 48 hours after a High Court in the Federal Capital Territory told Secondus that he was illegally occupying the office of the National Chairman of the PDP.
The suit that led to the ouster of Secondus was filed by a former Special Adviser on Political Affairs to ex-President Goodluck Jonathan, Alhaji Ahmed Gulak.
Gulak said he was the proper and fit person to occupy the office after its last National Chairman vacated the office.
He said since the sat National Chairman was from the North East, he should step into his shoes, also being from the geopolitical zone.
In his appeal dated December 16, 2015 and filed by Emeka Etiaba (SAN), Secondus and the PDP urged the Court of Appeal to set aside the entire judgement of the High Court.
The party and its chairman argued that the lower court erred in law when it held that the defendants’ preliminary objection was incompetent.
The party had argued in the objection that the suit concerns and touches upon the internal affairs of the party, adding that the plaintiff failed to pursue and exhaust the domestic remedies available to him before approaching the court.
Secondus urged the court to set aside the judgement and hold that the plaintiff does not have the locus standi to institute the action.
No date has been fixed for the hearing of the appeal.
