A former employee of Newswatch, Francis Iwuchukwu, has taken Newswatch Times Limited, former Newswatch Newspapers Limited, to the National Industrial Court of Nigeria, Lagos over non-payment of his seven months’ salary.
Iwuchukwu’s suit was filed by his counsel, Yemi Omodele.
Iwuchukwu, in his statement of fact, averred that he was employed by the defendant and given a letter of appointment dated October 1, 2012.
He said Newswatch did not give him a letter of confirmation of appointment after repeated demands.
Iwuchukwu said he was only told at the company’s registry: “You have been employed, carry on with your work.”
He said the company’s nonchalance towards the settlement of the outstanding salaries forced him to tender a letter of resignation on May 28, 2015, adding: “In spite of his constant visits and demand for his outstanding salaries, the defendant refused and neglected to pay same.
“This refusal prompted the claimant’s counsel, Mr Yemi Omodele to write a letter dated August 17, 2015 to the defendant demanding the payment of the outstanding salaries.”
According to the plaintiff, the defendant claimed that it deducted some money and remitted it to LeadWay Pensure Limited, which turned out be false.
“The plaintiff’s visit to Leadway Pensure Limited and request for savings account statement revealed that the defendant did not any money into the company.”
Iwuchukwu averred that the defendant’s action was fraudulent and constituted a clear intention to defraud him.
He wants a declaration of the court that non-payment of his salaries by Newswatch amounts to a breach of trust and a wilful intention to defraud him, adding: “The court should direct the defendant, its servants, agents and/or privies to pay forthwith the sum of N700,000 due to me as salaries for the period.”
No date has been fixed for the hearing of the suit.
