A former Chairman of the Economic and Financial Crimes Commission, Ibrahim Lamorde, has dragged the Senate, the Department of State Services and the Inspector General of Police, Solomon Arase, to court over his impending probe by the Senate on allegations of embezzling over N1 trillion recovered by EFCC under his watch.
Lamorde wants the court to decide whether the Senate and the Senate Committee on Ethics, Privileges and Public Petitions have the authority to invite him to appear before them.
In an originating summon filed by his lawyer, Festus Keyamo, Lamorde is asking the court to determine whether the Senate can invite him to appear before it as a person whose conduct of affairs is being investigated by them in relation to issues concerning the office he vacated.
Lamorde also wants the court to determine whether the defendants can issue a warrant of arrest against him without first issuing a summon.
He thus prayed the court to declare that in view of sections 88 and 89 of the 1999 Constitution, the Senate lacks the power to invite him to appear before it in relation to issues concerning an office he has already vacated.
He is also seeking an order of injunction against the Inspector General of Police and the Department of State Service restraining them from executing any warrant of arrest issued by the Senate.
No date has been fixed for the hearing of the suit.
Lamorde has been accused of withholding over N1 trillion recovered by the EFCC from a former Inspector General of Police, Tafa Balogun, and the late Governor of Bayelsa State, Dipreye Alamieyeseigha.
