The Court of Appeal on Monday shifted the hearing of the appeal filed against the Federal Government by a former National Security Adviser, retired Colonel Sambo Mohammed Dasuki.
The Court said the date for the hearing would be communicated to the parties.
The appellate court could not hear the appeal following the inability of the Federal Government (respondent) to file the brief of argument.
Dasuki had dragged the Federal Government to court over the failure to obey the order of the court for his release on bail based on his trial for an alleged $2.1 billion arms scam.
The counsel of the Federal Government, Rotimi Jacobs (SAN), had told the three-member panel of Justices of the Appeal Court that the appelant’s brief of argument was served on him last week and that by the practice of the court, he has 10 days to file his own respondent’s brief of arguments.
Jacobs then asked for a brief adjournment to enable him file his brief of argument.
Justice Aboli thus reserved the date for hearing until all processes have been filed.
