The Senate has called for the sack of the Director General of the Bureau of Public Procurement, Emeka Ezeh, describing his appointment as illegal.
The Senate on Thursday described Ezeh’s appointment was illegal, null and void as it contravenes Section 7 (1) of the National Council on Public Procurement.
The Senate said Ezeh’s appointment was not recommended by the Board of the NCPP as stipulated by the law setting up the agency.
Senator Ahmad Lawan sponsored the motion.
He was supported by Minority Whip, Ganiyu Solomon, Senators Nenadi Esther Usman, Smart Adeyemi, Suleiman Adokwe, Ayogu Eze, among others.
Leading said: “The Federal Government is yet to constitute the NCPP as provided for in Sections 1 (1) and 1 (4) of the Public Procurement Act of 2007.
“The Senate is worried that the non-appointment and non-inauguration of the NCPP has invariably rendered the execution of the Public Procurement Act, 2007 ineffective since the BPP is not legislated and designed to function alone as the directors of BPP shall be appointed by NCPP as provided for in section 2 (c) of the Act.”
The President of the Senate, Senator David Mark, said of the failure to constitute the Boad of the NCPP: “There’s sheer illegality here and the moment we clarify it, the better for everybody.
“Unfortunately, our resolutions are not binding.
“I remember that in the Sixth Senate, we agreed that two-thirds on any motion is binding.
“But we were not able to follow that through.
“Until we do that, we can’t say that our resolution would be binding.”
