An Akure, Ondo State Magistrates’ Court on Friday arraigned two timber operators, Saheed Babalola, 26; and Asimiyu Sodiq, 20, for allegedly raping a 46-year-old woman.
Police prosecutor, Corporal Matins Olowofeso, had told the court that the two accused persons had unlawful carnal knowledge with the lady by means of threat with cutlass on her way back from the farm.
Olowofeso said that the accused also attempted to have unlawful carnal knowledge of a 29-year-old woman.
He said that the two accused persons committed the offence on November 30 at about 7pm at Elefon Camp via Ofosu in Idanre Local Government Area of the state.
According to him, the offence is contrary to Section 357 and punishable under sections 516,358,359 and 360 of the Criminal Code Cap 37 Vol.1 Laws of Ondo State of Nigeria, 2006.
The accused pleaded not guilty to the four-count charge.
The counsel to the two accused, Francis Balogun, prayed the court to grant them bail in liberal terms under Section 118 of the criminal code laws of Ondo State, saying the accused were still presumed innocent.
Magistrate Olufunke Adegoroye granted the accused persons bail in the sum of N500,000 each with two sureties each in like sum.
Adegoroye said that the sureties must be resident within the court’s jurisdiction.
He said that they must fill an affidavit of means with two recent passports and one of the sureties must be civil servant of not less than GL 07.
The case was adjourned to January 29, 2014 for mention.
