The Olugbense ruling house of Offa, Kwara State has petitioned the Chief Justice of the Federation, Justice Mariam Aloma Muktar, praying her to reassign the stay-of-execution of judgment suit filed by the deposed Olofa of Offa, Mufutau Gbadamosi.
The petition, which was signed by Saka Keji on behalf of the ruling house, was dated October 8 and made available to the News Agency of Nigeria on Monday.
Keji stated in the petition that the Olugbense family had no confidence in the new panel of the Court of Appeal to which the suit had been assigned.
“We have no confidence that the new panel of justices can do justice to us in the case just as we have our fears and concerns on the motion for stay,” he added.
He prayed the CJN to reassign the two motions for stay of proceeding to another panel of justices of the Court of Appeal either in Ilorin Division or any other division.
Keji also pleaded that the cross appeal of the respondent, which was still pending, should also be reassigned to another panel.
“Your Lordship’s quick intervention, action and response in the overall interest of justice and restoration of confidence in the judiciary will be appreciated,” he added.
When the matter came up for hearing on Monday, the counsel to the Olugbense ruling house, Toyin Oladipo, told the court that he had just received a petition his client sent to the CJN.
Justice Raphael Agbo, who presided, said the petition was received by the court, adding that the case could not go on.
Agbo adjourned the case indefinitely until the response of the CJN was received.
