A member of the Edo State House of Assembly, Abdulrasak Momoh, charged with alleged armed robbery and illegal possession of fire arms has been remanded in prison till June 20.
Momoh is to remain in prison custody till a high court rules on his application for bail because the Chief Magistrates’ Court in Auchi has declined jurisdiction over the case.
The News Agency of Nigeria reports that suit has now been transferred to the High Court One, presided over by Justice S. Oigbookie in Auchi.
The Chief Magistrate, Caroline Nwoha, on May 7, remanded the lawmaker in the Auchi Medium Prison.
It will be recalled that Momoh was arrested on April 20, over the alleged crime.
The chief magistrate had ruled that her court lacked the jurisdiction to adjudicate in the case as it is an offence punishable under the Armed Robbery and Fire Arms Act.
She also directed the counsel to the accused to write the Director of Public Prosecution in the state for advice.
The magistrate then fixed June 3 for mention of the matter, pending the written information by the DPP.
