The anti-drug agency stated this when reacting to the discharge of Abba Kyari by Justice James Omotosho on a 23-count charge bordering on alleged non-declaration of assets filed against him by NDLEA.

Justice James Omotosho, in a judgment, dismissed the charge, filed against Kyari and his younger brothers, Mohammed Kyari and Ali Kyari, for failure of the anti-narcotic agency to prove its case beyond reasonable doubt.

He said this in the ongoing trial of Kyari and other four suspended police officers by Justice Emeka Nwite while being led in evidence by Onyechi Ikpeazu (SAN).
However, Umeibe and Ezenwanne, the 6th and 7th defendants in the case, pleaded guilty and were convicted accordingly by the court.

Kyari, who had been remanded in jail for 27 months over drug-related offences, was in May granted temporary 14-day bail.
The Nigeria Correctional Service confirmed this development in a short message service it sent to the media on Saturday.
Kyari, a Deputy Commissioner of Police, is expected to use the bail period to conclude the burial rites of his mother, Yachilla Kyari.

During the court’s proceedings, one of the principal suspects, Ayoade Akinninbosun told the court that a former Head of the Intelligence Response Team squad, Abba Kyari, offered him N10 million to implicate ex-Senate President, Dr. Abubakar Bukola Saraki, in the armed robbery case.
