The Lagos High Court has fixed January 8, 2018 to hear the suit filed by 20 homeowners against embattled Chairman of Lekki Gardens, Richard Nyong, and one of his estate development companies, Lekki Gardens Limited.
The News Agency of Nigeria reports that Kuyebi made the revelation before Justice Sybil Nwaka during the trial of Richard Nyong, the Managing Director of Lekki Gardens Estate Ltd and eight others.
Agwu, an Architect, disclosed this while giving evidence at an Igbosere High Court on Lagos Island.
The Lagos State Government had filed criminal charges against the Managing Director of Lekki Gardens, Richard Nyong, and five other contractors before Justice Sybil Nwaka over alleged negligence in the events leading to the building collapse which killed 34 persons
The State Government had dragged Nyong and one of the contractors handling the project, Odofin Taiwo Henry, to court, after which they were admitted to bail on some conditions, including the deposit of their international passports
The State’s Attorney General and Commissioner for Justice, Adeniji Kazeem, in a statement, said government has concluded its legal advice on the incident and is now ready to prosecute a total of nine suspects deemed culpable in the collapse of the building
Also in fulfillment of its constitutional mandate of ensuring that the law takes its course, the state government arrested and is currently prosecuting the Managing Director of Lekki Estate Worldwide and one of the contractors overseeing the collapsed building, sealed off the site of the collapsed building, sacked three senior officials of the state building control agency, as well as ordered the immediate sealing up of other Lekki estate buildings in the state in order to allow for integrity test to be conducted on them as a precautionary action to avert future catastrophe
Adesola said the test was ordered by Governor Akinwunmi Ambode to ascertain the fitness of all buildings constructed by Lekki Gardens.
The governor had on Tuesday ordered residents in all the buildings constructed by Lekki Gardens to vacate their apartments pending the conclusion of the integrity test
He said since the unfortunate incident, the state government has taken several steps to stem the tide of building collapse, adding that his administration is determined not to fail in the responsibility of ensuring the safety of lives and property of its citizens
The building had crumbled around 3am on Tuesday with several workers trapped in the rubble
