The Supreme Court on Thursday dismissed the election petitions filed against the re-mergence of Dr. Olusegun Mimiko as the governor of Ondo State.
The petitions were filed by Barrister Rotimi Akeredolu of the Action Congress of Nigeria and Barrister Olusola Oke of the Peoples Democratic Party.
Mimiko stood for the election on the platform of the Labour Party.
In the lead judgments, one of which was read by Justice Mary Odili, the Supreme Court said the petitioners lacked grounds for seeking the court’s intervention in pronouncing Mimiko not duly elected.
Justice Sylvester Nguto read the lead judgment in the case instituted by Akeredolu.
Nguto resolved the two surviving grounds for the application in favour of Mimiko.
The other eight grounds did not feature in the judgment.
Nguto said: “The two surviving issues lack merit and are therefore resolved in favor of the respondent.”
There was no dissenting voice among the seven justices that sat on the case.
The judges also all agreed with Justice Odili in the case of Oke, who contended largely that there were irregularities in the election process that threw up Mimiko as governor.
