An Abuja based lawyer, Dr. Kayode Ajulo, has enjoined President Muhammudu Buhari to adhere to the recent court ruling by releasing the former National Security Adviser, Col. Sambo Dasuki.
Ajulo stated this in a statement he released to the press on Wednesday and he regretted that despite the president earlier promised that that the federal government will not encroach on the duties and functions of either the Legislative or the judicial arms of government, the reverse has been the case.
Ajulo further enjoined President Buhari to “comply without fail” and obey the recent court ruling on the bail of Col. Sambo Dasuki stressing that the failure of the Buhari-led government not to grant him bail is a threat to the nation democracy.
He said: “I must emphatically point out that the failure of the Executive of Federal Government to allow Col. Dasuki enjoy bail which has been granted to him severally (six now in total) is a danger to our nascent democracy and those of us who are ministers in the temple of justice ought to cry out before we are buried in the sands of impunity.
“Take note that if Dasuki who is part of the few power elite could be treated with such impunity, then there is no such guarantee that other Nigerians/clients who are granted reprieve by the courts to the dissatisfaction of the government will be allowed their liberty as granted by the courts.”
Ajulo enjoined the Nigerian Bar Association to boycott the courts and the Attorney General of the Federation and Minister of Justice to resign his position if President Buhari does not adhere to the court ruling within seven days and also, he will not fail to boycott the courts and galvanize “like minds” to also do the same should the NBA jettisoned his appeal.
He stressed: “The efficacy of court rulings is in their applications by all parties irrespective of how they feel about such orders. The Executive of the Federal Government of Nigeria cannot be allowed to cherry pick which judgment to obey.
“It is an irony that the Executive recently finds it expedient to obey the Judgment of the Supreme Court on the Nigerian Football Federation after a long hesitation but not on Dasuki.”
Ajulo reiterated that if the executive continue to cheery pick court orders, it will endanger the authority of the judiciary which is supposed to be a separate arm of government and check the excesses of the executive as well as protect the fundamental human rights of the citizens.
