A High Court of the Federal Capital Territory sitting in Kubwa on Tuesday reserved judgement on the eligibility of Senator Ali Modu Sheriff as the National Chairman of the Peoples Democratic Party till Wednesday.
In the suit, no FCT/HC/BW/CV/39/16, the plaintiff, Danladi Ayuba, told the court that despite the subsisting judgement of Hon. Justice Valentine Ashi, which nullified the purported amendment of the provision of Article 47(6) of the Constitution of the PDP 2012 by which the defendant, Sheriff, is claiming entitlement to post of National Chairman of the party, he is not entitled to the position.
The plaintiff wants the court to determine whether Sheriff can continue to do anything legally on behalf of the party despite the binding and subsisting court judgement, which voided the amendment of the party’s constitution under the leadership Sheriff.
The hearing of notice is between Ayuba (Plaintiff) and Sheriff (defendant).
The judgement expected to be delivered on Wednesday (tomorrow) at 9am.
It could be recalled that an Abuja High Court sitting at Apo had sacked the factional Chairman of the PDP.
The court, in a judgment by Justice Valantine Ashi, declared as “unconstitutional, null and void” the purported amendment of Article 47 Rule 6 of PDP Constitution, 2012, at a special National Convention the party held on December 10 and 11, 2014.
It voided the said amendment on the basis that there was no compliance with mandatory provisions of Article 66 (2) and (3) of the PDP constitution.
Ash held: “By reason of the above, the purported amendments introduced to the constitution on the aforesaid dates, are hereby set-aside.
“All persons, individuals, servants or agents of PDP parading themselves as national officers of the PDP pursuant to the purported amendment which has now been nullified are hereby restrained from further parading themselves in these capacities.”
The judgment followed a suit marked FCT/HC/CV/1867/2016, which was lodged before the court by a chieftain of the PDP in Ondo State, Chief Joseph Jero.
