The National Judicial Council on Thursday, again, failed to recall the suspended President of the Court of Appeal, Justice Isa Ayo Salami.
The NJC hinged its refusal to recall Salami, who was suspended last year, on the cases over the matter before the Court of Appeal and the Federal High Court.
The NJC, which had earlier hinted it may recall Salami, reasoned that it would be pre-judicial to recall the embattled judge when the cases were still ongoing.
The members of the Council, it was learnt, were of the opinion that there was the need to allow for a definite position to be taken by the courts before reaching a final decision.
A three-man panel headed by the Chief Justice of Nigeria, Justice Mariam Aloma-Mukhtar, had earlier recommended to the Council, when Justice Dahiru Musdapher was the CJN, that Salami should be recalled.
The Aloma-Mukhtar panel also recommended that the President, Dr. Goodluck Ebele Jonathan, should approve the reinstatement of Salami.
Jonathan had insisted that Salami’s reinstatement can only come after the ongoing suits were adjudicated upon.
