For being in possession of Indian hemp and smoking same, a Minna,
Niger State Magistrate Court on Friday sentenced one Danlami Yusuf of
David Mark Road, Minna to 10 days in prison custody or pay a N10,000
as fine.
The 45-year-old Yusuf is a carpenter by profession, married and has children.
The Police Prosecutor, Corporal Emmanuel Bassa, had told the court
that the convict was charged for being in possession of dry leaves
suspected to be Indian hemp contrary to Section 319 (A) of the
Criminal Procedure Code.
Bassa also told the court that on July 4, 2013, one Saidu Garba,
attached to Maitunbi vigilante group in Minna, arrested the suspect
and brought him to Maitunbi Police Station, with a substance suspected to be Indian hemp.
He informed the court that during police investigation, the convict
admitted to owning the dry leaves later discovered to be Indian hemp
and pleaded guilty to the charge when it was read in court.
The prosecutor however prayed the court to apply Section 157 of the
Criminal Procedure Code and try the convict summarily since as an
accused person he had admitted committing the offence.
The convict had told the court that Indian hemp is his food because he smokes it every day but denied selling it and stated that it was
hunger that led him to hemp smoking.
The Magistrate, Alhaji Hassan Mohammed, considered that the convict
was the only bread winner of his family as his wife and two children
were in court to testify same and sentenced him to 10 days in prison
custody with option to pay N10,000 as fine.
