The All Progressives Congress in Kwara State has withdrawn the suit it filed against the Peoples Democratic Party challenging the October 26, 2013 local government elections in the state.
The party’s Secretary, Prince Yemi Afolayan, announced this in a letter dated May 8, 2014 and addressed to Deji Gbadeyan, its counsel, a copy of which was made available to the News Agency of Nigeria on Tuesday in Ilorin, the Kwara State capital.
Afolayan said in the two-paragraphed letter, entitled: “Withdrawal of suit N0. KWS/201/2013 in the High Court of Kwara State in Ilorin judicial division,” that the matter came to court on August 23, 2013.
“I wish to inform you that our party, the All Progressives Congress, is no longer interested in the matter which is in the court of Hon. Justice Kawu,” Afolayan said.
Copies of the letter were also sent to Adebayo Adelodun (SAN), counsel to Kwara State Independent Electoral Commission; the High Court Registrar; and the KWASIEC Chairman.
It would be recalled that the APC and six other plaintiffs had dragged KWASIEC, the PDP and the Labour Party to court, challenging the conduct of the October 26, 2013 local government election.
In the 10-paragraph affidavit filed by the party’s lawyer, Deji Gbadeyan, the party deposed that KWASIEC and PDP were bent on conducting and participating in the said elections on Saturday, knowing that all parties concerned were in court over the matter.
They prayed the court for an order of injunction restraining KWSIEC from conducting any election on Saturday into the councils of the state.
Justice Kawu in his ruling on October 25, 2013 dismissed the APC’s application to stop the election.
He ruled that the APC and the six other plaintiffs did not show enough reason to warrant his granting the injunction.
Kawu said the applicants had failed to satisfy him on why he should stop the local government election.
