A Grade 1 Area Court, sitting in Shagari Quarters, Abuja on Thursday discharged a 39-year-old Driver, Ikubaiyeje Gabriel, charged with assaulting and intimidating his wife, Kemi Ajinga.
The Judge, Sulyman Ola, discharged Gabriel following an application by the Prosecutor, Chinedu Ogada, that the case be struck out due to lack of interest by Ajinga.
Ola said having heard the prosecution’s application to strike out the suit for lack of interest by the complainant (Ajinga), the case is hereby struck out.
“The defendant is also discharged of all criminal charges and the First Information Report (FIR) is hereby withdrawn,” the judge said.
The defendant had pleaded not guilty to the charges and was granted bail.
Ogada told the court that Ajinga, who reported the matter at Dutse Alhaji Police Station, Abuja had refused to appear before the court to testify.
Gabriel, who resides in Dutse Sokale area of Abuja, was discharge on a two-count charge of assault and intimidation, contrary to Sections 265and 397 of the Penal Code.
Ajinga alleged that on Dec. 7, 2021 about 5p.m., her husband, (the defendant) assaulted her by beating and dragging her on the floor.
Ajinga claimed that the defendant beat her to a state of comma and later brought a knife with an intent to stab her, but was held back by their neighbours.
