The Federal High Court sitting in Port Harcourt, Rivers State has adjourned the hearing of Senator Andy Uba’s motion for interlocutory injunction to September 11.
The Judge, Justice Hyeladzira Nganjiwa, fixed the date in Port Harcourt on Tuesday following a motion brought by Ejike Oguebego, the factional Chairman of the Peoples Democratic Party in Anambra State.
The motion is seeking an order of court that Uba be declared as the Peoples Democratic Party candidate for the Anambra State governorship election.
Oguebego’s Counsel, Jude Nnodum, brought a motion, urging the court to compel the PDP and the Independent National Electoral Commission to recognise Uba as the party’s candidate for the November 16 governorship election in Anambra State.
The Oguebego-led faction, recognised by INEC, had challenged the decision of the PDP National Working Committee, which chose to recognise the Ken Emeakayi-led faction.
The Emeakayi-led PDP produced Tony Nwoye, a former President of the National Association of Nigerian Students, as the party’s candidate for the November 16 poll.
When the matter came up on Tuesday, the court rejected the PDP’s request that its motion challenging the court’s jurisdiction be taken first.
Counsel to PDP, Mmecha Kalu, argued that when the jurisdiction of a court had been challenged in a matter, the court ought to determine its powers to entertain the matter first.
Justice Nganjiwa declined the application and held that the court would entertain the motion for interlocutory injunction first.
Nnodum told newsmen that they want the PDP and INEC to accept the outcome of the primaries which produced Uba, pending the determination of the substantive suit.
