The Federal High Court in Abuja on Monday dismissed the suit by Senator Dino Melaye challenging the validity of the process of recalling him by his constituents, ordering the Independent National Electoral Commission to go ahead.
Melaye is the representative of Kogi West Senatorial District.
The Federal High Court had before now ordered INEC to stop action on the process.
On Monday, Justice Nnamdi Dimgba ruled that INEC “shall proceed with the recall process”.
The judgment effectively terminates the earlier ex parte order on July 6, 2017 by another judge of the Federal High Court in Abuja, Justice John Tsoho, directing parties to maintain status quo.
