Wale Babalakin, on Wednesday, failed to appear at the Ikeja High Court over his alleged role in a N4.7 billion money laundering allegation.
This is the second time Mr Babalakin could not appear in court.
The embattled Bi-Courtney boss is said to be receiving treatment over an undisclosed ailment at the Lagos University Teaching Hospital at Idi-Araba in Lagos .
The Economic and Financial Crimes Commission is accusing Mr. Babalakin, and one Alex Okoh of laundering the billions for convicted former Delta State Governor, James Ibori.
The judge, Adeniyi Onigbanjo, adjourned the case to January 17, 2013 for the hearing of pending applications and “a possible arraignment”.
Meanwhile, Ebun Sofunde, a Senior Advocate of Nigeria who is representing the Bi-Courtney boss Mr. Wale Babalakin has withdrawn from the suit.
Mr. Sofunde described his withdrawal as “a personal thing.”
“I have a letter from one Mr. Wale Akoni which shows that they don’t intend to oppose the application to withdraw,” said Mr. Sofunde.
However Bolaji Ayorinde, Another Senior Advocate,announced to the court that he would take over from Mr. Sofunde.
