The Court of Appeal sitting in Lagos has fixed April 18, 2013 to hear the appeal of the National Drug Law Enforcement Agency in the N25 million damages awarded against it for detaining popular comedian, Babatunde Omidina, widely known as Baba Suwe, on suspicion of drug ingestion.
The suit was said to have been wrongly listed, hence the need for a new date for the hearing.
The Court of Appeal panel is headed by Justice Chima Nweze.
NDLEA’s counsel, Femi Oloruntoba, had filed five grounds of appeal against the judgment of the lower court.
The Lagos High Court, presided over by Justice Yetunde Idowu, had on November 24, 2011 ordered the NDLEA to pay Omidina N25 million damages and apologise to the actor in conspicuous pages of two national dailies.
Omidina was arrested by the NDLEA at the Murtala Muhammed International Airport, Ikeja, Lagos on October 12, 2011 on allegations of ingestion of drugs.
He was held in custody for nine days.
