The trial of Maj. Sam Newline (rtd), for alleged N64. 8 million fraud was on Thursday stalled at the FCT High Court, Apo, due to absence of a prosecution witness.
The Independent Corrupt Practices and Other Related Offences Commission (ICPC) prosecuting counsel, Osuobeni Akponmisingha, informed the court that he was unable to produce his witness in court.
He further made an oral application for an adjournment to enable him bring his last witness to prove his case.
williams Ivara, counsel to the defendant, who opposed the application, argued that the prosecution has exhausted five adjournment he is entitled to by the Administration of criminal justice.
Ivara also sought an order of the court to foreclose the prosecution from calling any further witness.
Justice Olukayode Adeniyi, in a short ruling, held that considering the circumstance of the case.
He said: “I grant the adjournment.”
Adeniyi further adjourned the case until March 7, for continuation of trial.
The News Agency of Nigeria reports that Newline was arraigned on November 15, 2016.
He was arraigned on four counts of forgery and criminal breach of trust.
The ICPC alleged that the defendant made a false Access bank document tittle ” Bank Comfort Letter” which he intend it to act as genuine.
He also said that the defendant cheated Madukaife China by receiving the sum of N64. 8 million through his company Samsara Oil and Marine service ltd with knowledge to cause wrongful loss.
The offence, ICPC said contravened the provisions of section 364 and 323 of the Penal Code Law.
