An Oyo State High Court sitting in Ibadan on Tuesday refused Chief Adebayo Oyediji’s application seeking to stop the Olubadan-in-Council from appointing a new Olubadan.
The judge, Justice Muktar Abimbola, ordered that the respondents should be put on notice so that they could file their response.
Abimbola said the claimant had nothing to worry about, stressing that the court had the power to still remove the Olubadan even if he was appointed illegally as being claimed.
He, however, granted the application seeking to serve the respondents by pasting the writ of summon on the wall of the chamber of the Olubadan-in-Council at Mapo Hall, Ibadan South-West Local Government Area.
The court adjourned the case till March 8 for argument.
Oyediji’s Counsel, Abideen Adediran, had told the court that they were aware that the respondents had completed plan to appoint the new Olubadan of Ibadanland.
Adediran drew the attention of the court to its subsisting interim injunction restraining the respondents from filling any of vacant High Chief positions and that of the Olubadan.
He alleged that the Olubadan and the Balogun lineages had disobeyed the order of the court by filling all the vacant High Chief positions such as Ekerin, Asipa, Otun and Osi.
Adediran, therefore, prayed the court to set aside all the purported appointments.
The News Agency of Nigeria reports that Oyediji, of the Seriki Chieftaincy lineage, is claiming that the Seriki lineage should produce the next Olubadan following the death of Oba Samuel Odunlana.
He is also challenging the alleged consistent occupation of the throne by the Olubadan Chieftaincy lineage and the Balogun Chieftaincy lineage.
The state government, and other contending lineages to the Olubadan throne were joined as co-respondents.
