The Court of Appeal sitting in Abuja on Tuesday adjourned till August 9 the hearing of the appeal filed by Governor Okezie Ikpeazu of Abia State challenging his removal from office by a Federal High Court, Abuja.
Justice Morenikeji Ogunwumiju, who led four other justices of the court, said the adjournment was at the instance of all the parties.
Ogunwumiju said the adjournment became necessary in order to ensure that all processes were properly filed and exchanged.
Ogunwumiju, however, said all the parties in the matter must remain as they were before the case got to the appellate court.
“This decision should not be misinterpreted to mean a stay-of-execution as we are yet to decide anything,” she held.
The election of Ikpeazu of the Peoples Democratic Party was annulled by the Federal High Court court on June 27.
Justice Okon Abang who delivered the judgment, ordered the Independent National Electoral Commission to issue Uche Ogah, a PDP governorship contender, the Certificate of Return as the duly elected governor of Abia State.
